1. Agreement to These Terms
These Terms of Service (“Terms”) are a legal agreement between you and Keynomen LLC (“Keynomen,” “we,” “us,” or “our”), a Georgia limited liability company located at 415 Haven Lane, Marietta, GA 30066. They govern your use of the Keynomen Aviation website and applications (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please read Section 12 carefully. It requires most disputes to be resolved through binding individual arbitration and waives your right to participate in a class action, unless you opt out as described there.
2. What Keynomen Aviation Is — and Is Not
Keynomen Aviation is a reference tool for mastering the written language of aviation. It provides definitions, plain-language explanations, and related study material for aviation terminology.
Keynomen Aviation is not flight training. It is not a substitute for instruction from a certificated flight instructor, ground school, an approved training program, or any FAA-required course of study. It does not provide flight, ground, or recurrent training, does not satisfy any training, endorsement, currency, or certification requirement, and is not approved or endorsed by the Federal Aviation Administration or any other authority.
Always verify against authoritative sources. The content in the Service is for general educational and reference purposes only. It may contain errors, may not reflect the most current regulations or guidance, and is not tailored to any specific aircraft, operation, or situation. You are responsible for confirming all information against authoritative and current sources before relying on it, including but not limited to:
- The Pilot's Operating Handbook (POH) and Airplane Flight Manual (AFM) for your specific aircraft.
- Current FAA regulations, handbooks, the Aeronautical Information Manual (AIM), advisory circulars, and official source documents.
- Your certificated flight instructor, designated examiner, employer, or other qualified authority.
Aviation decisions can have serious safety consequences. Never make an operational, regulatory, maintenance, or safety-of-flight decision based on the Service alone. When the Service conflicts with an authoritative source, the authoritative source controls.
3. Eligibility and Accounts
You must be at least 13 years old to use the Service, and at least 18 (or the age of majority in your jurisdiction) to purchase a subscription. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
4. Instructor and Professional Access
We may offer certain access at no charge or at a reduced rate to certificated flight instructors or other qualified individuals. If you request such access, you represent that the credentials and information you provide are true and current. We may verify this information, and we may suspend or revoke access and charge applicable fees if it is inaccurate or if eligibility conditions are not met. Currently, verified certificated flight instructors receive complimentary Pro access for two years, granted immediately upon submitting a self-attestation and a photo of their instructor certificate; we may revoke it if eligibility is not met. We do not require you to promote or recommend the Service as a condition of this access.
5. Subscriptions, Trials, and Payments
Some features require a paid subscription. By subscribing, you authorize us and our payment processor to charge the applicable fees.
- Free account (no trial): A free account with limited access is available at no cost and does not require a payment method. We do not currently offer a paid free trial — full features require a paid subscription.
- Billing: Subscriptions renew automatically for the same term — monthly or annually, depending on the plan you choose — unless you cancel before the renewal date.
- Cancellation:You may cancel at any time from your account's billing settings, which open the secure Stripe customer portal. Cancellation takes effect at the end of the current billing period.
- Refunds: The free tiers let you evaluate Keynomen before paying. After you subscribe, you may cancel at any time and keep Pro access through the end of your paid period, but subscription payments are non-refundable except where required by law.
- Price changes: We may change prices, and we will give you advance notice before a change applies to your renewal.
Payments are processed by Stripe, Inc. and are subject to Stripe's terms.
5A. Text Messages
If you provide your mobile number and opt in, you agree that we may send you text messages through our messaging provider, Twilio Inc. Depending on your consent, these may include transactional messages (such as verification codes, subscription and account notices, and support responses) and promotional messages.
By opting in, you confirm that the mobile number you provide is yours and that you agree to receive the messages described at the point of opt-in. Consent to receive marketing text messages is not a condition of purchase. Message frequency varies, and message and data rates may apply.
You may opt out at any time by replying STOP to any message, and reply HELP for help. We handle mobile information as described in our Privacy Policy.
6. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial study, subject to these Terms.
You agree not to:
- Copy, scrape, harvest, or extract the Service's content, in whole or in part, by any automated or manual means, except as expressly permitted.
- Use the Service's content to train, fine-tune, or develop any machine-learning or artificial-intelligence model or dataset.
- Redistribute, resell, sublicense, or create derivative works from the Service's content.
- Share your account or access credentials with others.
- Reverse engineer, interfere with, or attempt to gain unauthorized access to the Service.
- Use the Service in any way that violates applicable law or these Terms.
7. Intellectual Property
The Service, including its content, definitions, organization, design, software, and the Keynomen and Keynomen Aviation names and marks, is owned by Keynomen LLC or its licensors and is protected by intellectual property laws. All definitions and explanations are original works created by Keynomen. Nothing in these Terms transfers any ownership rights to you.
8. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEYNOMEN LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Keynomen LLC and its members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our discretion. You may stop using the Service and cancel your subscription at any time. Provisions that by their nature should survive termination will survive.
12. Governing Law, Arbitration, and Disputes
Governing law. These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.
Binding arbitration.Except for the matters described below, you and Keynomen agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may take place in Cobb County, Georgia, or by telephone, video, or written submissions where the rules allow. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Class-action waiver.You and Keynomen agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. For any dispute not subject to arbitration, the exclusive venue will be the state or federal courts located in Cobb County, Georgia, and you consent to the personal jurisdiction of those courts.
Your right to opt out of arbitration. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@keynomen.com with your name, the email address on your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms. If you opt out, disputes will be resolved in the courts identified above.
Severability. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of this Section will remain in effect.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
